LittleHippo Mobile App Terms of Service

These Terms of Service ("Terms") govern your access to and use of the LittleHippo mobile application (the "App"), provided by LittleHippo, Inc. ("LittleHippo," "we," "us," or "our").

The App is designed to connect with and manage compatible LittleHippo products, including current and future smart devices (collectively, the "Devices").

By downloading, installing, accessing, or using the App, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree to these Terms, please do not use the App.

1. Eligibility and Parental Responsibility

The App is intended for use by adults, including parents and legal guardians, to configure and manage compatible LittleHippo products.

You must be at least 18 years old or have reached the age of legal majority in your jurisdiction to create an account and use the App independently.

Although certain LittleHippo products are designed for children, the App's account management and configuration features are intended to be controlled by adults.

Parents and guardians are responsible for supervising their children's use of connected Devices, selecting appropriate settings, and ensuring that Devices are used safely and in accordance with their instructions.

2. Description of Services

The LittleHippo App allows users to connect to, configure, and manage compatible LittleHippo products.

Depending on the Device, software version, and available functionality, features may include:

  • Creating and managing personalized routines, schedules, and settings.

  • Configuring sleep and wake-up preferences.

  • Managing alarms, timers, and reminders.

  • Adjusting lighting, sound, and other supported device functions.

  • Managing connected devices and user preferences.

  • Receiving software updates and accessing additional supported features.

Not all features are available on all Devices. Available functionality may vary by product model, region, operating system, and software version.

Certain features may require compatible hardware, Bluetooth, Wi-Fi, an internet connection, or other technical requirements.

We may introduce additional compatible products and features or modify existing functionality from time to time, subject to applicable law.

3. User Accounts and Security

Certain App features may require you to create an account.

When creating an account, you agree to provide accurate information and maintain the confidentiality of your login credentials.

You are responsible for activity occurring through your account, except to the extent caused by our failure to meet applicable legal or security obligations.

You agree to notify LittleHippo promptly if you suspect unauthorized access to your account.

We reserve the right to suspend or restrict accounts that violate these Terms, compromise the security of our services, or are used for fraudulent or unlawful purposes.

4. License to Use the App

Subject to your compliance with these Terms, LittleHippo grants you a limited, personal, non-exclusive, non-transferable, revocable license to download, install, and use the App for lawful, non-commercial purposes in connection with compatible LittleHippo products.

You may not:

  • Copy, distribute, sell, sublicense, or commercially exploit the App without our written permission.

  • Reverse engineer, decompile, or modify the App, except where expressly permitted by applicable law.

  • Attempt to gain unauthorized access to our systems, accounts, or connected devices.

  • Interfere with the App's functionality, security, or operation.

  • Use the App for unlawful, fraudulent, or harmful purposes.

  • Introduce malicious software or otherwise compromise the App or related services.

All rights not expressly granted remain reserved by LittleHippo.

5. Device Connectivity and Functionality

The App is designed to operate with supported LittleHippo Devices. We do not guarantee compatibility with third-party products or unsupported devices.

The App's performance may depend on factors outside our control, including internet connectivity, wireless signal strength, mobile device compatibility, operating system versions, and third-party service availability.

As a result, schedules, commands, alerts, synchronization, and other App functions may occasionally be delayed, interrupted, or unavailable.

You are responsible for verifying that important settings and schedules have been properly configured on your connected Devices.

LittleHippo Devices and the App are intended to assist with daily routines and other supported household functions. Unless expressly stated otherwise, they are not designed to serve as emergency alert systems, medical monitoring devices, or substitutes for appropriate adult supervision.

6. Children's Safety and Use

Certain LittleHippo products are designed for use in children's environments. However, parents and guardians remain responsible for supervising children and determining appropriate product settings.

The App and compatible Devices are intended as general household convenience and routine-management tools. They do not provide medical advice, diagnose or treat medical conditions or sleep disorders, or guarantee improvements in sleep quality, behavior, or development.

Parents and guardians should follow all applicable product safety instructions and ensure that connected Devices are used in an age-appropriate manner.

7. Privacy and Data Collection

Your privacy is important to us.

Our collection, use, disclosure, storage, and protection of personal information are described in our Privacy Policy, available at:

Depending on the features used, the App may process account information, device information, configuration settings, diagnostic information, and other data described in our Privacy Policy.

Any collection or processing of children's personal information will be governed by applicable privacy laws, including the Children's Online Privacy Protection Act (COPPA), where applicable.

By using the App, you acknowledge that you have reviewed our Privacy Policy.

8. Software Updates and Changes

LittleHippo may release updates to improve the App's functionality, compatibility, security, or performance.

Some updates may be required for continued access to certain features or compatibility with connected Devices.

We may modify, suspend, or discontinue portions of the App as reasonably necessary for operational, technical, security, or business reasons.

Where required by applicable law, we will provide appropriate notice of material changes.

We are not responsible for performance problems arising from unsupported devices, outdated operating systems, or failure to install necessary updates, except as otherwise required by law.

9. Intellectual Property

The App, including its software, design, graphics, text, logos, trademarks, and related content, is owned by LittleHippo or its licensors and is protected by applicable intellectual property laws.

LittleHippo and associated product names, brand names, and logos are trademarks or other intellectual property of LittleHippo, Inc.

Nothing in these Terms transfers ownership of any intellectual property to you.

You may not use our trademarks, logos, or proprietary materials without prior written authorization, except as permitted by law.

10. Third-Party Services

The App may rely on third-party technologies or services, including mobile operating systems, cloud infrastructure, connectivity platforms, and other service providers.

Your use of certain features may be subject to applicable third-party terms and policies.

LittleHippo is not responsible for interruptions or failures caused solely by third-party services outside our reasonable control. Nothing in this section limits rights or remedies that cannot lawfully be excluded.

11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND RELATED DIGITAL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

LITTLEHIPPO DISCLAIMS ALL WARRANTIES REGARDING THE APP, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE EXTENT SUCH DISCLAIMERS ARE PERMITTED BY LAW.

WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR COMPATIBLE WITH EVERY DEVICE OR SOFTWARE VERSION.

THE APP AND COMPATIBLE DEVICES DO NOT GUARANTEE ANY PARTICULAR SLEEP, BEHAVIORAL, OR DEVELOPMENTAL OUTCOME.

This disclaimer applies to the App and related digital services. It does not replace or diminish any applicable express warranty for LittleHippo hardware products or any non-waivable consumer rights.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LITTLEHIPPO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE APP, INCLUDING LOSS OF DATA, INTERRUPTION OF SERVICE, OR LOSS OF PROFITS.

TO THE EXTENT PERMITTED BY LAW, LITTLEHIPPO'S TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) $100 USD OR (B) THE AMOUNT YOU PAID DIRECTLY TO LITTLEHIPPO FOR ACCESS TO THE APP DURING THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Nothing in these Terms excludes or restricts liability for fraud, willful misconduct, personal injury, or any other liability that cannot lawfully be excluded or limited.

Some jurisdictions do not permit certain liability limitations, so portions of this section may not apply to you.

13. Termination

You may stop using the App at any time by uninstalling it and, where applicable, requesting account deletion.

You may request account deletion by contacting support@littlehippo.com.

We may suspend or terminate access to the App if you materially violate these Terms or if reasonably necessary to address security threats, unlawful activity, or misuse.

Termination of App access does not automatically affect your ownership of any LittleHippo hardware product.

Following termination, provisions concerning intellectual property, disclaimers, limitations of liability, disputes, and other terms intended to survive will remain in effect.

Personal information associated with terminated accounts will be handled in accordance with our Privacy Policy and applicable law.

14. Changes to These Terms

We may update these Terms periodically to reflect changes to the App, our products, business practices, or applicable laws.

When we make material changes, we will provide notice as required by applicable law, which may include notice through the App or our website.

The revised Terms will become effective on the date indicated in the updated version, subject to applicable notice and consent requirements.

Your continued use of the App after revised Terms become effective constitutes acceptance of those Terms to the extent permitted by law.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws require otherwise.

Any legal dispute arising from these Terms or the App will be brought before a court of competent jurisdiction in New York, subject to applicable law and any mandatory jurisdictional rights available to consumers.

Before initiating formal proceedings, we encourage you to contact us at support@littlehippo.com so we can attempt to resolve your concern informally.

Nothing in these Terms limits your right to seek relief from applicable consumer protection authorities.

16. Apple App Store and Google Play

If you download the App through Apple's App Store or Google Play, your use of the App is also subject to applicable platform terms.

For users who obtain the App through Apple's App Store:

  • These Terms are between you and LittleHippo, not Apple.

  • LittleHippo, not Apple, is responsible for the App and its content.

  • Your license to use the App on Apple-branded products is subject to Apple's applicable usage rules, including permitted Family Sharing arrangements.

  • Apple has no obligation to provide maintenance or support services for the App.

  • To the extent permitted by law, Apple is not responsible for claims relating to the App, including product liability, regulatory compliance, consumer protection, or intellectual property claims.

  • If the App fails to conform to an applicable warranty, you may notify Apple, and Apple may refund any purchase price paid for the App where applicable. LittleHippo remains responsible for other applicable warranty obligations, subject to law.

  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the applicable provisions against you.

You represent and warrant that you are not located in a country or region subject to applicable U.S. government embargo restrictions and are not listed on any applicable U.S. government prohibited or restricted parties list.

You agree to comply with applicable third-party terms when using the App.

17. General Provisions

If any provision of these Terms is found unenforceable, the remaining provisions will remain effective.

Our failure to enforce a provision does not constitute a waiver of our right to enforce it later.

These Terms, together with any policies expressly incorporated by reference, constitute the agreement between you and LittleHippo regarding use of the App.

These Terms govern the App and related digital services. Separate terms, warranties, and policies may apply to purchases of LittleHippo physical products.
